Fixation of pay of medically unfit running staff on being appointed against alternative post

Subject:  Fixation of pay of disabled/mentally unfit running staff on being appointed against alternative (stationary) posts in revised (6th CPC) structure.

Reference Railway Board’s letter No. E(NG)I-96/RE-3/9(2) dated 29.04.1999 containing procedure for absorption of disabled/mentally unfit Railway servant in          alternative employment, framed pursuant to the enactment of Persons with Disabilities (Equal  Opportunities, Protection of Rights and Full Participation) Act-1995.

2. Consequent upon implementation of revised pay structure inter-alia involving merger of various pre-revised scales and comprising running Pay Bands  & Grade Pay based on recommendations of 6th Central Pay Commission, a question has arisen regarding methodology for fixation of pay of medically unfit running staff on being posted/appointed against stationary posts. The matter has, accordingly, been considered by the Ministry of Railways (Railway Board) and based on the recommendations of a Committee constituted for the purpose, it has been decided that while determining pay in Pay Band for the purpose of fixation of pay of medically unfit running staff in alternative (stationary post), an amount equal to such percentage of basic pay (pay in Pay Band + Grade Pay) representing pay element of running allowance as may be in force from time to time may be added to the existing pay in Pay Band and the resultant figure (ignoring the fraction of rupee, if any) rounded off to the next multiple of 10, would be the pay in the Pay Band in the alternative post with no change in the Grade Pay of substantive post, in suitable alternative post . An illustration in this regard is enclosed as Annexure-I.

3. For this purpose, Para 1307 and 1308 of Indian Railway Establishment Manual, Volume-I, (Revised Edition-1989) First Re-print Edition-2009 may be amended as per Advanced Correction Slip No.224 as Annexure-II.

This issues with the concurrence of the Finance Directorate of Ministry of Railways.

 

Option of Pay fixation on account of promotion between 01.01.2006 and 29.8.2008

Subject:  Railway Services (Revised Pay) Rules, 2008 — Clarification under Second Proviso under Rule 5 regarding option on promotions between 1.1.2006 & the date of notification

Ref :  Railway Board’s Notification GSR 643(E) dated 04.9.2008.

1. Second proviso to Rule 5 of Railway Services (Revised Pay) Rules, 2008 provides that “Provided further that in cases where a Railway servant has been placed in a higher pay scale between 1.1.2006 and the date of notification of these Rules on account of promotion, upgradation of pay scale etc. the Railway servant may elect to switch over the revised pay structure from the date of such promotion, upgradation etc.” References have been received from some of the Railways and Federations seeking clarification regarding admissibility of option from the date of second promotion during the period 01.01.2006 to date of notification of Railway Services (Revised Pay) Rules, 2008.

2. The matter has been examined in consultation with Ministry of Finance and it is clarified that as per RS(RP) Rules, 2008, a Railway servant has the option to have his pay fixed from the date of his second promotion, if he has been granted two promotions/upgradations between 01.01.2006 and 29.8.2008. In such cases, however, the Railway Servant concerned will not be entitled to draw any arrears on account of 6th CPC w.e.f.01.01.2006 till the date of effect of option exercised on second promotion.

3. This issues with the concurrence of Finance Directorate of the Ministry of Railways.

 

Granting benefits of running allowance while fixing medically decategorised running staff

Subject:  Fixation of pay of medically decategorised running staff while kept on supernumerary posts- Granting benefits of running allowance- Regarding.

The question of fixation of pay of medically decategorised running staff for the period from the date they are declared unfit till their final absorption in alternative appointment i.e. the period during which they are kept on supernumerary posts for want of suitable alternative posts due to which it has not been possible to adjust the employees concerned immediately, has been engaging attention of the Board for quite some time.

  1. The matter has been considered by the Board and it has been decided that the pay of medically decategorised running staff while they are kept on supernumerary posts i.e from the date, they are declared medically unfit till the date they are absorbed in suitable alternative posts, needs to be suitably fixed by addition of the pay element of running allowance as may be in force. Their pay during this period will be fixed based on their pay in Pay-Band and Grade Pay plus pay element of running allowance as may be in force. As such, supernumerary posts wherever found necessary may be created at appropriate level. After fixation of pay in such a manner, no allowance in lieu of kilometerage shall be admissible.
  2. However, it is reiterated that there should be minimum delay in redeploying medically decategorized running staff against alternative posts. Serious efforts should be made to locate suitable alternative posts for such staff immediately and at the most within a period of three months. Any unreasonable delay must be avoided. It will be the responsibility primarily of the officer under whom the concerned Railway servant was directly working to find a suitable job for him.
  3. The instructions for fixation of pay of medically decategorised running staff on their absorption in suitable alternative posts will be issued separately.

 

Stepping up of pay of Senior employee with regard to direct recruits

Subject: Applicability of minimum pay/stepping up of pay- Clarification reg

1. A reference has been received from one of the Railways mentioning a case where an employee working as Accounts Clerk was promoted as Junior Accounts Assistant (GP ` 2800) after 01.01.2006 and his pay was fixed as per Rule 13 of Railway Services (Revised Pay) Rules, 2008 by adding 3% of Basic Pay and Grade Pay. On a subsequent date another employee (Junior to him) was appointed as Junior Accounts Assistant (GP 2800) through Direct Recruitment and his pay was fixed under Section II of Part-A of First Schedule of Railway Services (Revised Pay) Rules, 2008 which happened to be more than that of the above senior. A doubt has been raised whether stepping up of pay may be allowed in such cases to the senior employee who got promoted as Jr. Accounts Assistants (GP ` 2800) after 01.01.2006 vis-à-vis his junior who was directly recruited on a subsequent date as Junior Accounts Assistant (GP ` 2800) subject to fulfillment of conditions as laid down in Para 5 of Ministry of Railway’s letter No. PC-VI/2010/I/RSRP/1 dated 17.02.2010.
2. The issue has been examined in consultation with Ministry of Finance and it is clarified that pay of Senior employee promoted to a post after 01.01.2006 may be stepped up vis-à-vis his junior who was directly recruited on a subsequent date to the same post subject to the condition that they belong to the same seniority list for all purposes and various conditions as laid down in Board’s letter of even number dated 17.02.2010 are fulfilled.
3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

 

Fixation of pay of sport spersons recruitment against sports quota

Subject:  Fixation of pay of sportspersons recruitment against sports quota

Ref :  Board’s policy letter Nos. (i) E(Sports) 2000/Policy/2 dt. 19.06.2000 (ii) E(Sports)/2006/Policy/1 dt. 20.06.2006 and (iii) E(Sports)/2007/Policy/3 dt. 30.03.2007.

The matter of fixation of pay of sportspersons, (after the implementation of the recommendations of 6th Central Pay Commission), who were recruited from 01.01.2006 to 08.07.2009 on Zonal Railways & Production Units on higher stage of pay by granting additional increments at the time of their initial appointment, as per instructions contained in Railway Board’s letters referred above; has been examined in Board’s office, in consultation with Pay Commission and Finance Directorates.
In this connection it is clarified that fixation of pay of such sportspersons in the revised pay structure shall be as per Rule 8 of RS(RP) Rule 2008 and benefit of additional increments may then be added @ 3% at the minimum pay as per Rule 8/ Section-II of RS(RP) Rules 2008. Compounding of the Basic Pay for calculation of increments may not be admissible/justifiable in such cases.

 

Pay fixation of existing Group D Employees in the revised pay structure

Subject:  Clarifications regarding pay fixation of existing Group `D’ Employees in the revised pay structure

1.     Attention is invited to Railway Board’s letter of even number dated 12.01.2009 wherein clarifications were provided regarding various aspects of placement of the existing Group ‘D’ employees in the revised pay structure.

2     As per the clarification at Sl.No.1 of Railway Board’s letter dated 12.01.2009, those regular Group `D’ employees who did not posses the minimum qualification and who have retired/died in harness between 01.01.2006 and date of notification of Revised Pay Rules, 2008 will be granted pay band -IS and the grade pay corresponding to their pre-revised pay scale as notified in Railway Services (Revised Pay) Rules, 2008.

3. The aforesaid issue was raised in the 46th Ordinary Meeting of the National Council (JCM) held on 15 May, 2010 and the Staff Side had requested that the cases relating to the non-matriculate class IV employees who retired or died between January 2006 and the date of Notification of Revised Pay Rules, without any re-training be re-considered and such employees should be granted the benefit by re-fixing their pension/family pension at par with those employees who were retrained and whose pay was fixed in PB-1 with grade pay of  Rs. 1800/-.

4.     The request of Staff Side on the subject has been considered by the Government and it has been decided that the regular Group ‘D’ non-matriculate employees who died in harness or have retired between 01.01.2006 and the date of notification of Railway Services (Revised Pay) Rules, 2008, i.e. 04.09.2008, from the Railways would also be placed in PB-1 with grade pay of Rs.1800/- with effect from 01.01.2006. It should however be ensured that if any non-matriculate regular Group `D’ employees have been on leave due to which they could not be retrained, they should be retrained immediately on joining duty.

 

Fixation of pay and grant of increments in the revised pay structure

Subject:  Fixation of pay and grant of increments in the revised pay structure – Clarifications reg.

Following the notification of the Railway Services [Revised Pay] Rules, 2008, this Ministry has received references from some Railways seeking clarifications regarding fixation of pay in cases of Railway Servants drawing pay at maximum of the scale or drawing stagnation increment[s] in the pre-revised scale. The matter has been examined in consultation with Ministry of Finance, Department of Expenditure. The points of doubt and clarifications thereto are as under:

1 As per the proviso to Rule 10 of Railway Services [Revised Pay] Rules, 2008, in the case of persons who had been drawing maximum of the existing scale for more than a year as on the 1st day of January, 2006, the next increment  in the revised pay structure shall be allowed on the 1st day of January, 2006.  Whether the benefit of one additional increment under the proviso to Rule 10 of RS [RP] Rules, 2008 would be available even to those who had reached the maximum of the scale on 1.1.2005, i.e. drawing maximum of pay exactly for one year as on 1.1.2006? As already clarified vide Clarification No. 5 issued vide Railway Board’s letter No. PC-VI/2008/I/RSRP/1 dated  11.2.2009 [S.No. PC-VI/76, RBE No.28/2009] in all cases, where a Railway Servant has been granted an increment [whether normal annual increment or stagnation increment] after January 1, 2005, no increment will be allowed on 1.1.2006 at the time of fixation of pay in the revised pay structure.

 

From the foregoing, it is evident that in cases where Railway Servants have been granted an increment [whether normal annual increment or stagnation increment] after January 1, 2005,  no increment will be allowed on 1.1.2006 at the time of fixation of pay in the revised pay structure.  In other words, those who were granted their last increment  [whether normal annual increment or stagnation increment]  on or before 1.1.2005,  will be allowed an increment on 1.1.2006 at the time of fixation of their pay in the revised pay structure.

2 Whether even those employees who had already been granted one, two or three stagnation increments after reaching the maximum of the scale and thereafter drawing such pay for exactly one year [having drawn last stagnation increment on 1.1.2005] or more than one year as on 1.1.2006 are also to be granted benefit of one additional increment as per proviso to of Rule 10 of RS [RP] Rules, 2008?
3 In accordance with Note 7 below Rule 7 of the Railway Services [Revised Pay] Rules, 2008, in cases where the revised pay of a Railway Servant who was, immediately before 1.1.2006, drawing more pay than another Railway Servant junior to him in the same cadre, gets fixed in the revised pay band at a stage lower than that of such junior, his pay shall be stepped up to the same stage in the revised pay band as that of the junior.  Whether the provisions of this note will be applicable in the situation where such a senior Railway Servant who was immediately before 1.1.2006 drawing more pay than another Railway Servant junior to him in the same cadre gets fixed at a stage lower than that of such junior due to grant of additional increment as per 1st proviso to Rule 10 of RS [RP] Rules, 2008? Even though Note 7 below Rule 7of RS [RP] Rules, 2008, specifically states that the provisions contained therein shall be applicable in cases where pay fixation is done under Sub Rule [1] of Rule 7, it is clarified that the provisions of this Note shall also be applicable in the situations arising due to pay fixation of the junior employee under proviso to Rule 10 of RS [RP] Rules, 2008 .

 

Stepping up of pay of promotes with regard to direct recruits

Subject:  Applicability of minimum pay/stepping up of pay – clarification reg.

1. A number of references have been received in this office regarding applicability, for departmental promotees, of minimum entry pay prescribed for direct recruits ( appointed on or after 1.1.2006), in Section II of Part A of the First Schedule of RS(RP)Rules,2008. References have also been received regarding stepping up of pay of senior promotees with reference to such of their directly recruited juniors who are recruited on or after 1.1.2006 and whose basic pay is more than that of their seniors.

2.         The matter has been examined in consultation with Ministry of Finance. In this connection it is clarified that the revised pay structure comprises grade pays and running pay bands and in the case of those Railway servants who were already in service before 1.1.2006, Sixth Pay Commission has not prescribed a minimum pay in the running pay band with reference to the minimum entry level pay prescribed for direct recruits appointed on or after 1.1.2006. Further, the Sixth CPC has not prescribed minimum pay in the pay band for the purpose of fixation of pay on promotion in the case of any grade and fixing of minimum pay in the pay band in the case of each grade pay for departmental promotees would defeat the very purpose of introduction of running pay bands.

3.         As far as the matter relating to bringing the pay of existing Railway servants as on 1.1.2006 at par with the pay of direct recruits recruited on or after 1.1.2006 is concerned, it is clarified that the pay of those Railway servants who joined the Railway as direct recruits on or after 1.1.2006 is to be fixed as per Section II, Part ‘A’ of the First Schedule to the RS(RP)Rules,2008 and the procedure of pay fixation is based on a specific recommendation of the Sixth Pay Commission, which has been accepted by the Government. As far as pay fixation in respect to those Railway servants who were already in service on 1.1.2006 is concerned, the same is to be done as per the provisions of Rule 7 of RS(RP)Rules,2008 and in accordance with the fitment tables annexed with this Ministry’s letter No. PC-VI/2008/I/RSRP/1 dated 11.9.2008.

4.         In the light of the foregoing, it is clarified that in terms of RS(RP)Rules,2008:-

(a)          no minimum pay in the pay band can be prescribed in the case of promotion of Railway servants from one grade to another ( except in the case of change in pay band); and

(b)          pay of those Railway servants who were already in service on 1.1.2006 can not be fixed with reference to the minimum entry pay prescribed for those who joined the Railways as direct recruits on or after 1.1.2006 as per Section II, Part ‘A’ of the First Schedule to the RS(RP)Rules,2008.

5.            However, stepping up of pay of seniors can be permitted with reference to such of their directly recruited juniors borne on the same seniority list who are recruited on or after 1.1.2006 and whose basic pay is more than that of the seniors, subject to the following conditions:-

(a)          Stepping up of the basic pay of seniors can be claimed only in the case of those cadres which have an element of direct recruitment and in cases where a directly recruited junior is actually drawing more basic pay than the seniors. In such cases, the basic pay of the seniors will be stepped up with reference to the basic pay of the juniors. Stepping up will be applicable from the date junior direct recruit is actually drawing higher basic pay than the senior.

(b)           Further, Railway servants cannot claim stepping up of their revised basic pay with reference to entry pay in the revised pay structure for direct recruits appointed on or after 1.1.2006 as laid down in Section II of Part A of First Schedule to the RS(RP)Rules,2008, if their cadre does not have an element of direct recruitment, or in cases where no junior is drawing basic pay higher than them.

(c)          Stepping up of pay of the seniors shall not be applicable in cases where pay of direct recruits has been fixed at a higher stage on account of grant of advance increments etc. at the time of recruitment.

 

Anomaly in fixation of pay of Loco Supervisory staff and stepping up of pay

Subject:  Anomaly in fixation of pay of Loco Supervisory staff appointed prior to 01.01.2006 with reference to their juniors appointed after 01.01.2006 and drawing more pay than the seniors

1.             It has come to the notice of the Board that staff appointed prior to 01.01.2006 as Loco Running Supervisors in the pre-revised scales, whose pay has been fixed in the replacement pay structure for Loco Running Supervisors  under the RS[RP] Rules, 2008, are drawing less pay than their juniors appointed as Loco Running Supervisor after 01.01.2006.  The anomaly has arisen due to the fact that the benefit of element of Running allowance granted at the time of promotion of running staff to a stationary post  has been granted to the junior in the revised pay structure, whereas, the same benefit granted to the senior is of lesser value as the same has been calculated on pre-revised pay scale.

2.         It has been decided that the anomaly may be resolved by granting stepping up of pay in the pay band to the seniors at par with the juniors in terms of Note 10 below Rule 7 of RS[RP] Rules, 2008.

3.         The benefit of stepping up of pay in the pay band will be subject to the following conditions:

[a]        Both the junior and the senior Railway servants should belong to the same cadre and the posts in which they have been promoted should be identical in the same cadre and other conditions enumerated in Note 10 below Rule 7 of RS[RP] Rules, 2008 should also be fulfilled.

[b]        The stepping up of pay will be allowed to running staff only appointed as Loco Supervisors in whose cases 30%  of basic pay is taken as pay element in the running allowance.  The stepping up of pay will not be admissible to the non-running staff of Mechanical Deptt.  appointed as Loco Running Supervisors as in their cases the question of pay element in the running allowance does not arise;

[c]        If even in the lower post, revised or pre-revised, the junior was drawing more pay than the senior by virtue of advance increments granted to him or otherwise, stepping up will not be permissible;

[d]        Stepping up will be allowed only once, the pay so fixed after stepping up will remain unchanged;

[e]        The next increment will be allowed on the following 1st July, if due, on completion of the requisite qualifying service with effect from the date of refixation of pay, as per the provisions of Rule 10 of RS[RP] Rules, 2008.

4.         This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

 

Fixation of initial pay in the revised pay structure of Medical officers in the pay band PB-4

Subject:  Fixation of initial pay in the revised pay structure of Medical officers in the pay band PB-4

1.            Vide illustration 2 contained in Explanatory Memorandum to the Railway Services (Revised Pay) Rules,2008, method of fixation of initial pay in the revised pay structure of Medical Officers was issued by this Ministry. Subsequently, clarifications have been sought from various quarters regarding method of pay fixation in the revised pay structure of those Medical officers, whose revised pay is to be fixed in the Pay band PB-4.  In this connection, it is clarified that in the case of those Medical Officers whose pay is to be fixed in the pay band PB-4, their pay in the pay band will be fixed with reference to the fitment table corresponding to their pre-revised pay scale as per Annexure ‘E’ to the Ministry’s letter of even number dated 11.09.2008. The method of fixation of their pay in the revised pay structure will be the same as prescribed in illustration 2 of the Railway Services (Revised Pay) Rules,2008. However, in order to guide administrations/ PAOs in fixing the revised pay of Medical Officers in the pay band PB-4 correctly, an illustration in this regard is annexed with this letter.

2.         This issues with the concurrence of Finance Directorate of the Ministry of Railways. Action may be taken accordingly.

Date of next increment in cases where Railway Servants are not able to join posts in a particular grade pay on promotion on 1st of January of a year

Subject:  Date of next increment in cases where Railway Servants are not able to join posts in a particular grade pay on promotion /appointment on 1st of January of a year due to Sunday or Gazetted Holiday – Clarification regarding

1.            As per the provisions of Rule 10 of RS[RP] Rules, 2008, w.e.f. 01.01.2006 in the case of all Railway employees there is a uniform date of increment, i.e.1st of July of every year.  Railway servants completing six months and above in the revised pay structure as on 1st  of July are eligible to be granted the increment.  From the above provision of RS[RP] Rules it flows that Railway servants who have rendered less than 6 months of service as on 1st of July of a year will not be eligible to draw increment on that day and their date of increment will fall 12 months later on next 1st of July.  Accordingly, all the Railway servants who join posts in a particular grade  on account of promotion / appointment etc. on 1st January of a year will be eligible to draw their annual increment on the 1st of July of that year.  However, those who join the posts between 2nd January and 30th June will not be eligible for the same.

2.         In the light of the above position, clarification has been sought regarding the date of next increment in cases where Railway servants are not able to join posts in a particular grade pay on promotion /appointment on first of January of a year due to 1st of January falling on a Sunday or Gazetted holiday.  It has been clarified by the Ministry of  Finance, Department of Expenditure that in the normal course, if a Railway servant was to join post in a grade pay on appointment /promotion on 1st of January of a year, but he could not join the post only because 1st of January of the year happened to be a Sunday or Gazetted holiday the Railway servants who join the posts on the 1st working day of the year will be treated to have completed 6 months of service on 1st of July of that year for the purpose of granting them annual increment on that day.

Stepping up of pay of Head Clerks at par with Senior Clerks who were upgraded on the recommendation of Fifth CPC as Head Clerks

Railway Board Letter No: PC-V/99/I/6/1 dated 19.02.2009

Subject:  Stepping up of pay of Head Clerks at par with Senior Clerks in receipt of special pay of Rs.70/- p.m who on recommendation of Fifth CPC were upgraded as Head Clerks and placed in the same scale of Rs.5000-8000 w.e.f 1.1.96

1.            Pursuant to the issue of Board’s letter dated 17.8.98, an anomaly arose in as much as those Sr.Clerks who were in receipt of special pay and promoted as Head Clerks prior to 01.01.1996 were fixed at a lower stage as on 1.1.96 vis-à-vis those Sr. Clerks in receipt of special pay but promoted as Head Clerk after 1.1.1996.

2.         In view of the above, the matter has been examined in Board’s office and it has been decided that in accordance with Note 1 below Rule 8 of  RSRP Rules,1997, the pay of Head Clerks ( grade Rs.1400-2300) may be stepped up at par with Senior Clerks ( grade Rs.1200-2040) in receipt of Spl. Pay of Rs.70/- who, on the recommendation of Fifth CPC were upgraded as Head Clerks and placed in the same scale of Rs.5000-8000 w.e.f. 1.1.1996. The benefit of stepping up of pay, wherever admissible, will be allowed only in cases where the promotion was on a regular basis and from the date the junior employee started drawing more pay than his senior.

3.         The stepping up of pay in these cases will be subject to the fulfillment of the conditions of natural principles viz. (i) both senior and junior employees belonged to the same cadres in the lower and higher posts and their scales of pay in the two posts were also identical; (ii) the senior employee was drawing equal or more pay than junior in the lower post; (iii) the senior employee was promoted earlier than his junior; and (iv) the next increment of such a senior will be drawn on completion of the required qualifying service from the date of re-fixation of pay.

4.         Further, the stepping up of pay will not be allowed in the following cases:-

a)    where an employee, even though senior was not found suitable for appointment to the identified posts of Senior Clerks carrying special pay;

b)    where the Sr. employee declined to accept deployment/appointment  or was appointed at a later date than the junior to the identified posts for whatsoever reasons whereby he draws less pay than the junior, in such cases senior cannot claim stepping up of pay at par with junior;

c)    where an employee was away outside the cadre at the time when his junior was appointed to the identified post;

d)    where a senior proceeds on extra ordinary leave which results in postponement of date of next increment in the lower post, consequently he starts drawing less pay than his junior in the lower grade itself. He, therefore, cannot claim pay parity on promotion;

e)    where the employee has been promoted to the post of Head Clerk against quota reserved for SC/ST/OBC/Sports etc. even before becoming eligible for the identified post carrying special pay;

f)     where junior gets more pay due to additional increments earned on acquiring higher qualifications or on sports account; and

g)    where a senior was appointed later than the junior in the lower post itself whereby he is in receipt of lesser pay than the junior, in such cases also senior cannot claim parity in the higher post though he may have been promoted earlier to the higher post.

 

Fixation of pay and grant of increments in the revised pay structure and resubmission of option on Promotion

Subject:  Fixation of pay and grant of increments in the revised pay structure – clarifications reg

1.            Following the notification of the Railway Services [Revised Pay] Rules, 2008, this Ministry has received references from some Railways/ Production Units seeking clarification regarding various aspects of fixation of pay in the revised pay structure as also pay fixation and grant of increments in future under the revised pay structure.  The matter has been examined in consultation with Ministry of Finance, Department of Expenditure.  The points of doubt and the clarifications thereto are as under:

As per the provisions of Rule 1313 {FR22[1][a][1]} of Indian Railway Establishment Code, Vol.II, [Sixth Edition  1987, 2nd Reprint, 2005] split option has to be submitted by the eligible employee [other than those appointed on deputation to ex-cadre post or ad hoc basis or on direct recruitment basis] within one month of promotion.  Some of the employees promoted before 01.01.2006 as well as after 01.01.2006 but before notification of Railway Services [Revised Pay] Rules, 2008  implementing 6th CPC recommendations, had opted for their pay fixation on promotion from the date of their next increment which was falling after 01.01.2006 in the 5th  CPC scales as per the rules / pay structure then in force. Consequent upon implementation of 6th CPC in September 2008 effective from 01.01.2006, the option submitted by a number of employees has now turned to be disadvantageous. Whether such employees may be allowed to revise their options under Rule 1313 {FR 22 [I] [a] [1]}of Indian Railway Establishment Code, Vol.II [ Sixth Edition 1987, 2nd Reprint, 2005]. Railway Board’s letter No. E[P&A]II-2003/PP-1 dated 16.10.2003 provides that a Railway Servant may give a revised option for fixation under Rule 1313 {FR22[1][a][1]} of Indian Railway Establishment Code, Vol.II, [Sixth Edition  1987, 2nd Reprint, 2005] within one month from the date of orders of such unforeseen developments or change of rules.  In any such cases that have resulted from the notification of Railway Services [Revised Pay] Rules, 2008, Railway servants may be allowed to exercise a revised option for fixation of their pay in the promotion post within one month from the date of issue of these clarifications.
2 As per Rule 5 of the Railway Services [Revised Pay] Rules, 2008 , a Railway Servant placed in a higher pay scale between 01.01.2006 and the date of notification of these rules on account of promotion, upgradation of pay scales etc. can elect to switch over to the revised pay structure from the date of such promotion [i.e. after placement in the promotional grade], upgradation etc.  The employees promoted or upgraded to higher grade have option to have their pay fixed / re-fixed as per the provisions of  Rule 1313 /1317 {FR 22 FR 23 }of Indian Railway Establishment Code, Vol.II [ Sixth Edition 1987, 2nd Reprint, 2005] from the date of next increment etc.

 

Whether such employees covered by Rule 5  of Railway Services [Revised Pay] Rules, 2008, can also revise their options  now to choose either from the date of promotion / upgradation or the date of increment etc. [ which may fall on the 1st July 2006, 2007, 2008 or 2009 etc.] as annual increment in the new structure is  given uniformly on the 1st July?

 

Whether such option will also be available in the cases of ad-hoc promotions [whether or not followed by regularization without break].

Proviso to Rule 5 of the Railway Services [Revised Pay] Rules, 2008 states that  a Railway Servant may elect to continue to draw pay in the existing scaleuntil the date on which he earns his next or any subsequent increment in the existing scale, or until he vacates his post, or ceases to draw pay in that scale.

 

The Rule ibid further provides that in cases where a Railway servant has been placed in a higher pay scale between 1.1.2006 and the date of notification of these Rules on account of promotion, upgradation of pay scale etc. the Railway servant may elect to switch over to the revised pay structure from the date of such promotion, upgradation etc.

 

It is clarified that  such cases  will be regulated under proviso to Rule 5 of the Railway Services [Revised Pay] Rules, 2008.  After switching over to the revised pay structure, Clarification 2  [ the method of fixation of pay on promotion after 1.12006] issued vide Board’s letter of even number dated 25.9.08 will apply.

 

 

In the case of  adhoc promotions granted between 1.1.2006 and date of notification of Railway Service [Revised Pay] Rules, 2008, a Railway servant has the option to have his pay fixed under proviso to Rule 5.  However, Clarification 2  [ the method of fixation of pay on promotion after 1.12006]  issued vide Board’s letter of even number dated 25.9.08 will not   apply in such cases.

3 As per Rule 13 [i] of Railway Services [Revised Pay] Rules, 2008, in case of promotion from one grade pay to another and that involving change of pay band, one increment equal to 3% of basic  may be allowed and in addition higher grade pay of the promotional post may also be allowed.  As per clarification 2 of Board’s letter of even number dated 25.09.08 on promotion  from one grade to another, a Railway servant has an option under Rule 1313 {FR 22 [I] [a] [1]}of Indian Railway Establishment Code, Vol.II [ Sixth Edition 1987, 2nd Reprint, 2005] to get his pay fixed in the higher post either from the date of his promotion or from the date of his next increment.  As per the provisions of Rule 1313 {FR 22 [I] [a] [1]}of Indian Railway Establishment Code, Vol.II [ Sixth Edition 1987, 2nd Reprint, 2005] the benefit of fixation under above rule is admissible only in cases of appointment involving duties and responsibilities of greater importance.  Further, the grant of option under above FR is also subject to the condition that the appointment is not on deputation on ex-cadre basis / ad-hoc or direct recruitment basis.

 

It is not clear whether:

[a] Rule 1313 {FR 22 [I] [a] [1]}of Indian Railway Establishment Code, Vol.II [ Sixth Edition 1987, 2nd Reprint, 2005] still holds good in its present form with all the attendant conditions; or

[b] the same has got modified on introduction of Sixth Central Pay Commission Pay structure, and if yes

[c] What is the extent of modification to above FR.

Point No. [a] Rule 1313 {FR 22 [I] [a] [1]}of Indian Railway Establishment Code, Vol.II [ Sixth Edition 1987, 2nd Reprint, 2005] still holds good.

 

Point No. [b] & [c] : Clarification No. 2 of Board’s letter of even number dated 25.09.08 prescribes the method of fixation of pay under Rule 1313 {FR 22 [I] [a] [1]}of Indian Railway Establishment Code, Vol.II [ Sixth Edition 1987, 2nd Reprint, 2005] after introduction of the system of pay bands and grade pay.

4. Methodology for rounding off:

As per Rule 9 of the notification, the rate of increment in the revised pay structure will be 3% of the sum of the pay in the pay band and grade pay applicable, which will be rounded off to the next multiple of 10.  Whether rounding off to next multiple of 10 has to be done in terms of rupees or even a paisa has to be rounded off to next multiple of 10.  For example, if the pay after drawal of increment works out to Rs.10510.10 the same has to be rounded off to 10520 or 10510.

In the case of Fitment Tables annexed with Board’s letter of even number dated 11.9.08 and 12.9.08 rounding off has already been done and the same should be implemented without any modification.

 

In the case of calculation of increments under the revised pay structure, paise should be ignored, but any amount of a rupee or more should be rounded off to next multiple of 10.  To illustrate, if the amount of increment comes to Rs.1900.70 paise, then the amount will be rounded off to Rs.1900; if the amount of increment works out to be 1901, then it will be rounded off to Rs.1910.

5. Grant of stagnation increment:

Whether the employees who have been granted stagnation increment between February 2005 or thereafter are to be granted additional increment w.e.f. 1.1.2006, while fixing the pay or not?  Since they have reached at the maximum of the existing pay scale.

 

In all cases, where a Railway servant has been granted an increment [whether normal annual increment or stagnation increment] after January 1, 2005, no increment will be allowed on 1.1.2006 at the time of fixation of pay in the revised pay structure.

2.        This issues with the concurrence of   Finance Directorate of the Ministry of Railways.

 

Placement and fixation of pay of Group D Railway employee

Railway Board Letter No:  PC-VI/2008/I/3/1 dated 12.01.2009

Subject:  Placement and fixation of pay of Group ‘D’ Railway employees [other than RPF/RPSF] in Grade Pay Rs.1800 in Pay Band-1 [Rs.5200-20200]-Clarification

As per recommendations of 6th CPC, instructions for placement and fixation of pay of Group ‘D’ Railway employees [other than RPF/RPSF] in Grade Pay Rs.1800 in Pay Band-1 [Rs.5200-20200] were issued vide Board’s letter of even number dated 29.10.2008 [RBE No. 160/2008].

In reference to above instructions, some of the Railways/Units have sought clarification regarding those Group ‘D’ staff who did not possess the revised minimum qualification, and have retired/ resigned /Voluntarily retired / expired during the period from 01.01.2006 till date of notification of the Revised  Pay Rules – 2008, without getting retrained.

The matter has been examined in consultation with Ministry of Finance  and the points of doubt raised by some of Zonal Railways / Units and the clarifications thereto are as under:

2 In the case of those Group ‘D’ officials  who were in the pre-revised scale of Rs.2550-55-2660-3200 [e.g. Peon] and who are to be placed in the pay band PB-1 with Grade Pay of Rs. 1800 w.e.f. 01.01.2006 and are subsequently granted ACP /Promotion, is not  clear as to what will be their grade pay.  If the grade pay remains  unchanged, the officials will not be getting any benefit on promotion / ACP.  In case  they are granted next higher grade in the hierarchy of revised pay structures, it will put seniors viz.Duftry / Senior Peons etc. at a disadvantageous position. Railway servants who have been granted financial upgradation to a higher scale under the ACP scheme will be granted the grade pay corresponding  to the higher pre-revised pay scale that was granted to them under ACP.  However, in case of erstwhile Group ‘D’ employees, all such eligible employees will be granted grade pay of Rs.1800 in PB-1, irrespective of their pre-revised Group ‘d’ pay scale whether granted to them on regular appointment / promotion or under ACP.

This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

 

Date of next increment and method of fixation of pay on promotion

Subject:  Clarifications on Railway Services (Revised Pay) Rules, 2008.

1.              The undersigned is directed to refer to the Railway Services [Revised Pay] Rules, 2008, notified vide G.S.R. No. 643[E] dated 4th September, 2008 and to state that clarifications are being sought regarding the date of next increment, the method of fixation of pay on promotion after 01.01.2006, use of fitment tables for cases of pay fixation under Rule 11 of RS[RP] Rules, 2008, fixation of pay of railway servants who were on deputation on 1.1.06 and got promoted in the cadre subsequently while still on deputation etc.

2.              In this connection, the following clarifications are issued:

Clarification 1:  The date of next increment

[i]           As per Rule 10 of RS[RP] Rules, 2008 there will be one uniform date of annual increment, viz., 1st July of every year.  Railway servants completing 6 months and above in the revised pay structure as on 1st of July will be eligible to be granted the increment.   Accordingly, all railway servants who earned their last increment between 02.01.2005 and 01.01.2006 would get their next increment on 01.07.2006.

[ii]          For those employees whose date of next increment falls on 01.01.2006, the instructions already provide for granting an increment in the pre-revised pay scale as on 01.01.2006 and then fixing their pay in the revised pay scales. Such railway servants would also get their next increment on 01.07.2006.

Clarification 2:  The method of fixation of pay on promotion after 01.01.2006: 

On promotion from one grade to another /financial upgradation under ACP, a railway servant has an option under Rule 1313 [FR22[I][a][1] Indian Railway Establishment Code Vol.II [Sixth Edition 1987 -2nd Reprint, 2005] to get his pay fixed in the higher post either from the date of his promotion, or from date of his next increment, viz., 1st July of the year.  The pay will be fixed in the following manner in the revised pay structure:

[a]          In  case the railway servant opts to get his pay fixed from his date of next increment, then , on the date of  promotion, pay in the pay band shall continue unchanged, but the grade pay of the higher post will be granted.  Further refixation will be done on the date of his next increment i.e. 1st July.  On that day, he will be granted two increments; one annual increment and the second on account of promotion.  While computing these two increments, basic pay prior to the date of promotion shall be taken into account.  To illustrate, if the basic pay prior to the date of promotion was Rs.100, first increment would be computed on Rs.100 and the second on Rs.103.

[b]          In case the railway servant opts to get his pay fixed in the higher grade form the date of his promotion, he shall get his first increment in the higher grade on the next 1st July if he was promoted between 2nd July and 1st January.  However, if he was promoted between 2nd January and 30th June of a particular year, he shall get his increment on 1st July of next year.

Clarification 3:  Use of fitment tables for cases of pay fixation under Rule 11 of RS[RP] Rules, 2008.

Rule 11 of RS[RP] Rules, 2008 provides for fixation of pay in the revised pay structure subsequent to the 1st day of January, 2006.  When the pay of a railway servant will be fixed as per Rule 11 on a date subsequent to 01.01.2006, the fitment tables annexed with Board’s letter of even number dated 11.09.2008 will be used as prescribed in the relevant provisions contained in para 2 of the said letter.  The pre-revised pay to be reckoned in such cases will be the pay of the railway servant on the day of such fixation.

Clarification 4:  Fixation of pay of railway servants who were on deputation and got promoted in the cadre subsequently while still on deputation.

[i]         In case the railway servant was on deputation on 1.1.06 and got promoted to a higher post in his cadre after 1.1.06, but was not granted proforma promotion under the ‘Next Below Rule’, his pay will get fixed w.e.f. 1.1.06 in the grade which he was holding on 1.1.06.

[ii]         In case the railway servant had been granted proforma promotion under the ‘Next Below Rule’, his pay will be fixed using the provisions of ‘Next Below Rule’ as explained in [iii] below:

[iii]        In the revised  pay structure, the pay of a Railway servant would be regulated in the following manner on grant of proforma promotion to him under ‘Next Below Rule.’

[a]        In case a Railway servant on deputation to a post gets promoted in his cadre to a post in a higher grade, his pay in the pay band will be fixed with reference to the pay in the pay band of the employee immediately junior to him in the cadre of his service.  However, the railway servant in question would continue to draw the grade pay attached to the deputation post for the remaining duration of the deputation.

[b]        In case a Railway servant on deputation to a post in PB-4 gets promoted in his cadre to a post in HAG+, his basic pay will be fixed with reference to the basic pay of the employee immediately junior to him in the cadre of his service, but the total of pay in the pay band and grade pay of the deputation post will not exceed Rs.79, 000.

[c]        In case a Railway servant on deputation to a post in PB-4 gets promoted in his cadre to a post in the apex scale, his basic pay will be fixed with reference to the basic pay of the employee immediately junior to him in the cadre of his service, but the total of pay in the pay band and grade pay of the deputation post will not exceed Rs.79,000.

[d]        In case a Railway servant on deputation to a post in HAG+ gets promoted in his cadre to a post in the apex scale, his basic pay will be fixed with reference to the basic pay of the employee immediately junior to him in the cadre of his service.

 Clarification 5:    Fixation of pay of Railway servants who go on deputation to a lower post.

[i]         In case a Railway servant goes on deputation to a post carrying  a lower grade pay, his pay in the pay band would continue unchanged, but he will be granted the grade pay of the lower post for the entire duration of the deputation.

[ii]         In case a Railway servant in HAG+ scale goes on deputation to a lower post in PB-4,  his basic pay in the deputation post will be fixed at a stage equal to his basic pay in the cadre of his service, but the total of pay in the pay band and grade pay of the deputation post will not exceed Rs.79,000.

[iii]        In case a Railway servant in the apex scale goes on deputation to a lower post in PB-4, his pay in the pay band will be fixed at the maximum of the PB-4 [Rs.67000] and he will be granted the grade pay attached to the deputation post, but the total of pay in the  pay band and grade pay of the deputation post will not exceed Rs.79,000. In case deputation is from the apex scale to a post in HAG+, the basic pay will be protected in HAG+.

Clarification 6:    Procedure for placing employees in upgraded scales in case of merger of scales / upgradations recommended by the Sixth CPC.

[i]         Where all posts in one or more pre-revised scales are merged with a higher pre-revised scale and given a common replacement scale/grade pay, the suitability of the incumbents need not be assessed for granting them the higher replacement scale / grade pay and the incumbents will automatically be granted the replacement pay scale /grade pay recommended by the Commission.  Their pay will be fixed in accordance with the fitment table annexed to Board’s letter of even number dated 11.09.08.

[ii]         Similarly, in the case of upgradations, recommendation by the Pay Commission, i.e., where all  posts in a particular grade have been granted a higher replacement pay scale / grade pay, the suitability of the incumbents need not be assessed for granting them the higher replacement scale/ grade pay.  The incumbents will automatically be granted the replacement pay scale / grade pay recommended by the Commission.  Their pay in the pay band will be fixed with reference to their fitment table corresponding to pre-revised pay scale.  However, the grade pay corresponding to the upgraded post will be granted.

Note:  Railway Services [Revised Pay ] Rules, 2008 define the term ‘basic pay’ in the revised pay structure as the pay drawn in the prescribed pay  band plus the applicable grade pay but does not include any other type of pay like special pay, etc..  In the case of Railway servants in the pay scales of HAG+ and above, basic pay means the pay in the prescribed scale.

 

Fixation of pay of Running staff as per Sixth Central Pay Commission recommendation

Subject:  Implementation of Sixth Central Pay Commission’s recommendation – Fixation of pay for Running staff.

1.            Please refer to Board’s letter of even number dated 11.09.2008 wherein detailed instructions regarding fixation of pay in the revised pay structure have been given.  Detailed fixation tables for each stage in each of the pre-revised scales have also been provided as Annexure to that letter.

2. Detailed fixation tables [FTR 1-7] for each stage in each of the pre-revised scales of Running staff are enclosed.   Provision for stagnation increments has also been made in each  of the table.  The fixation tables are worked out in consultation with the Ministry of Finance.

3. This issues with the concurrence of the Finance Directorate of Ministry of Railways.

 

Sixth Pay Commission – Schedules of Revised Scales of Pay for Railway employees

Railway Board Letter No:  PC-VI/2008/I/RSRP/I dt.  11/09/2008

Subject:  Railway Services [Revised Pay] Rules, 2008 – Schedules of Revised Scales of Pay.

1.Reference Railway Services [Revised Pay] Rules, 2008, notified vide G.S.R. No. 643-E dated 4.9.2008 and forwarded with Railway Board’s endorsement  No. PC-VI/2008/I/RSRP/1 dated 4.9.2008 on the above subject.

2.      Schedule in two parts viz. Annexure ‘A’ and ‘B’ showing the revised pay structure applicable to the various categories of Railway employees in Group ‘D’, ‘C’, ‘B’ and ‘A’ is enclosed.  Notification for Group ‘A’ and ‘B’ where higher replacement pay structure is to be given will be issued separately.  The revised pay structure take effect from 1st January, 2006.  The schedule has the sanction of the President.

3.      In terms of Rule 6 of the Railway Services [Revised Pay] Rules, 2008, Railway servants are required to exercise their options in the format appended as Second Schedule to the Rules.  The sequence of action to be taken on receipt of the option will be as follows:

[i]      The manner of initial fixation of pay in the revised pay structure has been indicated in Rule 7 of the Railway Services [Revised Pay] Rules, 2008.  On the basis of this Rule, detailed Fixation Tables for each stage in each of the pre-revised scales have been circulated by the Ministry of Finance under their OM No. F. No. 1/1/2008-IC dated 30.08.2008.  The Fixation Tables pertaining to the scales of pay structure as applicable in the First Schedule to the Ministry of Railways’ notification referred to above and Schedules annexed with this letter are enclosed as Annex-E of this letter.  These may be used for the purpose of fixation in the revised pay structure as on 1.1.2006.  The detailed Fixation Tables in respect of running staff are being issued separately.

[ii]      The Tables in Annex-E will be applicable in cases where the Government has approved normal replacement pay scales.  In cases of upgradation of posts and merger of pre-revised pay scales, fixation of pay will be done as prescribed in Note 2A and 2B below Rule 7[1] and in the manner indicated in illustration 4A & 4B   respectively of the  Explanatory Memorandum to   the Railway Services [Revised Pay] Rules, 2008.

[iii]     In terms of the Railway Services [Revised Pay] Rules, 2008, there shall be a uniform date of increment i.e. 1st July of the year after implementation of the revised pay structure.  Consequently in the case of employees whose date of next increment falls on 1.1.2006, the increment will be drawn in the pre-revised scale and pay fixed in accordance with the tables after including this increment.  The next increment in the revised pay structure in such cases will be drawn on 1st July 2006.

[iv]    On fixation of pay in the applicable revised pay bands and grade pay or in the pay scale, as the case may be pay and allowances for the month of September, 2008 [or wage period of September –October, 2008] may be drawn and paid on the basis of the revised pay structure and the applicable allowances thereon after deduction of enhanced subscription to the State Railway Provident Fund which will be calculated with reference to the revised basic pay.  Insofar as the employees who have joined on or after 1.1.2004 are concerned, the enhanced deductions  under the New Pension Scheme will be calculated with reference to the revised basic pay and DA thereon.

“Basic Pay” in the revised pay structure means the pay drawn in the prescribed pay band plus the applicable grade pay but does not include any other type of pay like special pay, etc.  In the case of Government servants in the pay scales of HAG+ and above, basic pay means the pay in the prescribed scale.

[v]     Bills may be draw separately in respect of the arrears of pay and allowances for the period  from January 1, 2006   to August 31, 2008.  The aggregate  arrears computed after deduction of subscription at enhanced rates of SRPF and New Pension Scheme with reference to the revised pay, may be paid in two instalments, the first being restricted to 40% of the aggregate arrears.  DDOs/PAOs concerned will ensure that action is taken simultaneously in regard  to Government’s contribution towards enhanced subscription.  Orders in regard to the payment of the second instalment of arrears will be issued separately.

[vi]    Similar sequential action as indicated above may be taken for the authorization of the revised pay and allowances of those employees whose options might be received later.

4.      The revised rates of all allowances, such as House Rent Allowance, Transport Allowance, Children Education Allowance, Special Compensatory Allowance, Special Duty Allowance etc. will be paid prospectively w.e.f. 1.09.08.  Accordingly, no arrears will be paid in respect of these allowances.  However, Dearness Allowance and Non-Practising Allowance for medical doctors  at rates notified separately, will be payable w.e.f. 1.1.2006 or from the date of option.

5.      With a view to expediting the authorization and disbursement of arrears, it has been decided that the arrear claims may be paid without pre-check of the fixation of pay in the revised scales of pay.  The facility to disburse the arrears without pre-check of fixation of pay will not, however, be available in respect of those Government servants who have relinquished service on account of dismissal, resignation, discharge, retirement etc. after the date of implementation of the Pay Commission’s recommendations but before the preparation and drawal of the arrear claims, as well as in respect of those employees who has expired prior to exercising their option for the drawal of pay in the revised scales.

6.      In order to ensure correct and systematic fixation of pay in the revised pay structure, a Proforma for the purpose [Statement of Fixation of Pay is enclosed [Annex-C].  The statement should be prepared in triplicate  and one copy thereof should be pasted in the Service Book of the Railway employee, the second copy kept for office record and the third copy to be set to the Accounts Officer for post check.  The instalment of Dearness Allowance sanctioned from 1.7.2006 onwards in the present scale will be adjusted against the instalments & Dearness Allowance payable under revised formula in the arrears on account of revision of pay scales.

7.      The requirement of pre-check of pay fixation having dispensed with, it is not unlikely that the arrears due in some cases may be computed incorrectly leading to overpayments that might have to be recovered subsequently.  The Drawing & Disbursing Officers should, therefore make it clear to the employees under their administrative control, while disbursing the arrears, that the payments are being made subject to adjustment from amounts that may be due to them subsequently should any discrepancies be noticed later.  For this purpose, an undertaking  may also be obtained in writing from every employee at the time of disbursement of the arrears/pay and allowances for September, 2008 [or wage period of September-October] to the effect that any excess payment that may be found to have been made as a result of incorrect fixation of pay in the revised scales will be refunded by him to Government either by adjustment against future payments or otherwise.  A specimen form of the undertaking is also enclosed [Annex-D].

8.      In authorizing the arrears, Income Tax due may also be deducted and credited to Government in accordance with the instructions on the subject.  In case a Government servant wishes to deposit his arrears in his State Railway Provident Fund account, this may be permitted.

9.      On receipt of the necessary options action for drawal and disbursement of arrears should be completed immediately.

Resubmission of option for fixation of pay on promotion due to change in rules or Pay Commission changes

Subject:  Option for fixation of pay on promotion – regarding

Ref :  Rule 1313 (FR 22)(I)a(1) of R-II, 1987

1.  Attention is invited to the provision relating to exercise of option by a Railway employee for fixation of pay on promotion/appointment to the higher grade/post under Rule 1313 (FR 22(I)(a)(1)R-II/1987 edition.

2.         The staff side raised a demand in the National Council (JCM) that a Central Government servant may be allowed to revise the option exercised by him on promotion/appointment to the higher post/grade under FR 22(1)(a)(i) in the event of unanticipated developments or change of rules etc.  The Staff side also demanded that a specific provision to this effect be incorporated in the existing rules/orders.  The matter has been examined by the Government and the President is pleased to decide that pursuant to any unforeseen developments or change of rules, a Railway employee may given a revised option for pay fixation under Rule 1313 (FR 22(I)(a)(1)R-II/1987 edition within a period of one month from the date of issue of orders of such unforeseen  developments or change of rules.  Proposal for acceptance of such revised  option may thereafter be referred to this office along with detailed  justification there for and verbatim remarks of FA&CAO, which will be examined and decided on merits in consultation with Department of Personnel & Training.  In case it is decided to allow fresh option to the Railway employee concerned, the option once exercised shall be treated as final.  Past cases of similar nature can also be referred to the Board, which will be decided on merits.  The Zonal Railways etc. are requested to bring the above decision to the notice of all concerned.

This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
